This clause of the US Constitution reads "Congress shall make no law respecting an establishment of religion", and forbids the government from establishing an official state religion. It also prevents the government from establishing religious preferences. It has a sister clause commonly called the "Free Exercise Clause" that prevents the government from interfering with with the free exercise of religion.

The alleged infringement of government by fundamentalists is upsetting to some groups, including religious moderates and non-believers (agnostics and athiests).

An examples of something that may violate the establishment clause:

  • Jewish family flees Delaware school, because of district's alleged aggressive Christianity [1]

An example of free speech, that may be interpreted incorrectly as a violation:

  • Seventy-seven foot tall Statue of Liberty holding a cross on church property [2]
